Each Raffle Ticket is a donation to Upability Foundation.
By participating in this raffle, you agree to these terms and conditions listed below.
Upability Foundation Raffle: Terms and Conditions
By participating in the Upability Foundation Raffle (the “Raffle”), you agree to comply with and be bound by the following Terms and Conditions:
Eligibility:
The raffle is open to residents of jurisdictions where such raffles are not prohibited by law.
Employees, board members, and immediate family members of Upability Foundation are ineligible to participate.
Entry:
Each raffle entry is obtained by purchasing a ticket, with each ticket priced at $[5, 10, 25, 50, 100].
Tickets are non-refundable, and all sales are final.
There is no limit on the number of tickets an individual may purchase.
The raffle entry deadline is [12/24/2024, 11:59pm].
Upability Foundation reserves the right to disqualify any participant who violates these terms and conditions.
Prizes:
The prize(s) for the raffle will be specified on the official raffle page or promotional materials.
Prizes are non-transferable and non-exchangeable for cash or other items unless explicitly stated.
Upability Foundation reserves the right to substitute any prize with one of equal or greater value if the original prize becomes unavailable.
Winners are responsible for all taxes, fees, or additional costs associated with the receipt and use of the prize(s).
Minimum Ticket Requirement:
The winner of the raffle will only be selected if at least 5,000 tickets are sold.
In the event that fewer than 5,000 tickets are sold by the raffle deadline, Upability Foundation reserves the right to extend the raffle period or refund all ticket purchases.
Upability Foundation may also choose to modify the prize or donate a portion of the proceeds to the organization's cause if fewer than 5,000 tickets are sold.
Winner Selection:
Once the minimum of 5,000 tickets is sold, winners will be drawn randomly from all eligible entries.
The draw will take place on [12/25/2024, 2:00PM] at [Upability HQ].
Winners will be notified via the contact details provided at the time of entry. If the winner cannot be contacted within [30] days, Upability Foundation reserves the right to redraw the prize.
The decision of the Upability Foundation in relation to the winner is final and binding.
Claiming Prizes:
Winners must claim their prize within [30] days of being notified.
If a winner is unable to collect the prize in person, they may be responsible for any shipping or delivery costs.
Unclaimed prizes after the specified period will be forfeited and may be awarded to another participant or used for future fundraising activities.
Limitation of Liability:
By participating, entrants agree to release and hold harmless Upability Foundation, its board members, employees, volunteers, and sponsors from any liability, claims, or damages arising out of participation in the raffle or the acceptance and use of any prize.
Upability Foundation is not responsible for lost, late, misdirected, or incomplete entries.
Publicity:
By entering the raffle, winners agree to allow Upability Foundation to use their name, likeness, and city of residence for promotional purposes without additional compensation, unless prohibited by law.
Data Privacy:
Personal information collected during the raffle will be used solely for the purposes of administering the raffle and contacting winners.
Upability Foundation will not share or sell personal information to third parties.
Changes to the Raffle:
Upability Foundation reserves the right to modify, suspend, or cancel the raffle at any time without prior notice due to unforeseen circumstances or technical issues.
Governing Law:
These Terms and Conditions are governed by the laws of the State of [Virginia] and are subject to the exclusive jurisdiction of its courts.
